Agreement to terms

By accessing or using the Apptifi website (apptifi.com) or the Apptifi bandwidth scheduling platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Apptifi ("we," "our," or "us").

Description of service

Apptifi is a bandwidth scheduling platform designed for enterprises using Lumen Internet-on-Demand (IoD) Network-as-a-Service (NaaS) circuits. The Service enables users to schedule bandwidth changes, automate IoD API orders, calculate pricing, and optionally synchronize with Microsoft 365 calendars. Apptifi acts as an automation layer between you and the Lumen NaaS API — we are not a network service provider and do not provide internet connectivity or bandwidth directly.

Account and access

To use the Service, you must subscribe to a plan and provide accurate, complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Subscriptions and payment

Apptifi offers paid subscription plans billed monthly or annually. All payments are processed through Stripe. By subscribing, you authorize us to charge the applicable fees to your payment method on a recurring basis until you cancel.

Plan changes. You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the start of the next billing cycle.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.

API credentials and circuit management

You are solely responsible for the NaaS API credentials you provide to Apptifi and for ensuring you have proper authorization to manage the IoD circuits connected to your account. You acknowledge that bandwidth changes submitted through Apptifi will result in real changes to your production circuits and corresponding billing from your network service provider.

We strongly recommend testing all scheduling configurations in the sandbox environment before applying them to production circuits.

Acceptable use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to other users' accounts or data; interfere with or disrupt the Service or its infrastructure; reverse engineer, decompile, or disassemble any aspect of the Service; resell or redistribute the Service without our written consent; or use the Service to submit fraudulent or unauthorized API orders.

Service availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service depends on third-party infrastructure including the Lumen NaaS API, hosting providers, and payment processors, which are outside our control. We are not liable for downtime, delays, or failures caused by third-party service interruptions.

Intellectual property

The Service, including its design, code, documentation, and content, is owned by Apptifi and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your subscription.

Limitation of liability

To the maximum extent permitted by law, Apptifi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of revenue or profits, cost of replacement services, loss of data, or bandwidth charges incurred as a result of automated scheduling errors. Our total liability for any claim arising from or related to the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements, that bandwidth orders will always be processed successfully, or that the pricing calculator will reflect exact charges from your network service provider.

Indemnification

You agree to indemnify, defend, and hold harmless Apptifi and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from: your use of the Service, your violation of these Terms, your provision of inaccurate API credentials or circuit information, or any unauthorized bandwidth orders submitted through your account.

Modifications to terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any modification constitutes acceptance of the updated Terms.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts.
